1. Agreement to these terms

These Website Terms of Use ("Terms of Use") govern your access to and use of signthechart.com, chartsmart.signthechart.com, our blog, our free resources, and our online store (together, the "Site"), operated by Nursing Current LLC d/b/a SignTheChart ("SignTheChart," "we," "us," or "our").

By accessing or using the Site, you agree to these Terms of Use. If you do not agree, do not use the Site.

Our Privacy Policy and Disclaimer are incorporated into these Terms of Use by reference.

2. Purchases are governed by a different agreement

These Terms of Use govern your use of the Site. They do not govern purchases.

Every purchase you make from us is governed by our Terms of Purchase, our Refund Policy, and the license that applies to what you bought, either our Template License or our Course License.

This is true regardless of where you check out. We currently accept payment through two checkouts: the store on this website, and our product platform at chartsmart.signthechart.com. Both are operated by SignTheChart, and the same Terms of Purchase, Refund Policy, and product licenses apply to both. If there is any conflict between these Terms of Use and the Terms of Purchase with respect to a purchase, the Terms of Purchase control.

3. Who may use the Site

The Site is intended for adults. By using it you represent that you are at least 18 years old. Our content is written for licensed clinicians and clinicians in training. It is professional education, not patient education, and it is not directed to patients or the general public seeking medical care.

If you are a patient or a member of the public seeking medical care, contact a licensed healthcare provider. If you are experiencing a medical emergency, call 911 or go to your nearest emergency department.

4. Do not send us patient information

Do not send us, post on the Site, or enter into any form, comment, survey, or tool:

  • Protected health information or any patient identifier

  • Screenshots of a patient record, chart, encounter, inbox, or message

  • Employer confidential, proprietary, or internal information

We are not a covered entity or a business associate under HIPAA, and nothing on the Site is configured to receive or store protected health information. If you send us information of this kind we will delete it and may decline to respond. De-identify any clinical scenario before you describe it to us. See Section 2 of our Privacy Policy.

5. Accounts

Some areas of the Site and our product platform require an account. You are responsible for the accuracy of the information you provide, for keeping your credentials confidential, and for all activity that occurs under your account.

You may not share your credentials or allow another person to access paid material using them. Notify us at support@SignTheChart.com if you learn of unauthorized access to your account. We may suspend or terminate any account at our discretion, including for credential sharing.

6. Free resources and email

When you download a free resource, register for a free training, or subscribe to our list, you agree to receive email from us. You may unsubscribe at any time using the link in any marketing email.

Free resources are provided for your own personal professional use. They are subject to the same restrictions in Section 8 and may not be resold, redistributed, posted publicly, or shared as your own.

7. Acceptable use

You agree not to:

  • Use the Site for any unlawful purpose, or in violation of any applicable federal, state, local, or international law

  • Impersonate any person or misrepresent your identity, credentials, licensure, or affiliation

  • Attempt to gain unauthorized access to any part of the Site, any account, any server, or any paid material you have not purchased

  • Circumvent, disable, or interfere with any security, access control, paywall, or authentication feature

  • Introduce any virus, malware, or other harmful code, or take any action that imposes an unreasonable load on our infrastructure

  • Use the Site to harass, threaten, defame, or discriminate against any person

  • Use the Site or our content to solicit our audience, promote a competing product, or recruit customers, subscribers, or clients

  • Use any robot, spider, scraper, or other automated means to access the Site except as described in Section 9

8. Our content and what you may do with it

All content on the Site, including articles, text, templates, phrasing, structures, frameworks, images, graphics, video, audio, design, and their selection and arrangement, was created by Candice Elam, DNP, FNP-C, is owned by Nursing Current LLC d/b/a SignTheChart or its licensors, and is protected by copyright, trademark, and other intellectual property law.

You may, for your own non-commercial personal and professional use: read and view our content, print or save a single copy of a blog article for your own reference, and share a link to any public page.

You may not, without our prior written permission: copy, reproduce, republish, distribute, sell, or post our content elsewhere in whole or in substantial part; use our content in any course, training, presentation, newsletter, product, or client deliverable; frame or mirror the Site; or remove any copyright notice, attribution, or watermark.

Quoting a short excerpt of a blog article with clear attribution and a link back to the original page is permitted and welcome.

Paid materials carry their own license. See the Template License and the Course License.

9. Automated access, indexing, and AI

We want our public content to be found, indexed, quoted, and cited, including by search engines and AI assistants, provided the source is attributed and linked.

You may not use any automated means to scrape, harvest, or bulk copy content from the Site, and you may not use our content to train, fine-tune, or ground any artificial intelligence or machine learning model, or to build any dataset, corpus, product, or tool, without our prior written permission. Attributed retrieval, citation, and summarization that links back to the original page are permitted. Ingestion for model training is not.

This section does not limit the more restrictive terms that apply to paid materials under our product licenses.

10. Comments and anything else you submit

If you post a comment, review, question, testimonial, image, or other material on the Site or send it to us ("User Content"), you keep ownership of it and you grant us a non-exclusive, royalty-free, worldwide, perpetual, irrevocable license to use, reproduce, adapt for length or clarity, publish, and display it in connection with our business, unless you tell us in writing that we may not.

You represent that your User Content is your own, does not infringe anyone's rights, contains no protected health information or patient identifier, and contains no employer confidential information.

We are not obligated to publish or keep any User Content, and we may edit or remove any submission at any time for any reason, including because it is off topic, promotional, abusive, or contains information that should not have been posted. We are not responsible for User Content posted by others. Views expressed by third parties are their own.

11. Trademarks

SignTheChart, Chart Smart, Message Master, and our logos and related names and slogans are trademarks of Nursing Current LLC. You may not use them without our prior written consent. Other names and marks appearing on the Site are the property of their respective owners, and their appearance does not indicate affiliation, sponsorship, or endorsement.

12. Third-party links and affiliate links

The Site contains links to third-party websites and resources, some of which are affiliate links. We are not responsible for the content, accuracy, availability, privacy practices, or clinical validity of any third-party site, and a link is not an endorsement. Your dealings with any third party are between you and that third party. See our Disclaimer for our affiliate disclosure.

13. Copyright complaints

If you believe content on the Site infringes your copyright, send a written notice to support@SignTheChart.com with the subject line "DMCA Notice," including: identification of the work you claim is infringed, identification of the material on the Site you claim is infringing and its location, your contact information, a statement that you have a good faith belief the use is not authorized, a statement under penalty of perjury that the information is accurate and that you are the owner or authorized to act on the owner's behalf, and your physical or electronic signature.

14. Disclaimers

The Site and everything on it are provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Site will be uninterrupted, secure, error-free, current, or free of viruses or other harmful components. Your use of the Site is at your own risk.

All content on the Site is educational and informational only. It is not medical, nursing, clinical, legal, financial, or tax advice, and no professional-client relationship is created by your use of the Site. See our Disclaimer, which applies in full.

15. Limitation of liability

To the maximum extent permitted by law, SignTheChart, Nursing Current LLC, Candice Elam, DNP, FNP-C, and our members, officers, employees, contractors, agents, licensors, and service providers will not be liable for any indirect, incidental, special, punitive, exemplary, or consequential damages arising out of or connected with your use of or inability to use the Site, including any professional liability claim, licensure or disciplinary action, employment action, audit, loss of revenue, loss of goodwill or reputation, or loss of or damage to data, whether or not foreseeable.

To the maximum extent permitted by law, our total aggregate liability for any claim arising out of or relating to the Site will not exceed one hundred dollars ($100), or the amount you paid us in the twelve months preceding the claim, whichever is greater.

The foregoing does not affect any liability that cannot be excluded or limited under applicable law.

16. Indemnification

You agree to indemnify, defend, and hold harmless SignTheChart, Nursing Current LLC, Candice Elam, DNP, FNP-C, and our members, officers, employees, contractors, agents, licensors, and service providers from and against any third-party claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to your use of the Site, your User Content, your breach of these Terms of Use, or your violation of any law or third-party right.

17. Availability, changes, and termination

We may change, suspend, or discontinue any part of the Site at any time, including any content, feature, or product, without notice. We are not liable if any part of the Site is unavailable at any time or for any period.

We may terminate or suspend your access to the Site, in whole or in part, at any time and without notice, including for any breach of these Terms of Use. Sections 4, 8, 9, 10, 11, and 13 through 20 survive termination.

18. Governing law, jurisdiction, and venue

These Terms of Use are governed by the laws of the State of New Jersey, without giving effect to any choice or conflict of law provision.

Any suit, action, or proceeding arising out of or relating to these Terms of Use or the Site must be brought exclusively in the state or federal courts located in Hudson County, New Jersey, and you irrevocably submit to the exclusive jurisdiction and venue of those courts.

19. General

Entire agreement. These Terms of Use, together with our Privacy Policy and Disclaimer, are the entire agreement between you and us regarding your use of the Site. Purchases are separately governed as described in Section 2.

Changes to these Terms of Use. We may revise these Terms of Use at any time. The "Last updated" date reflects the most recent revision. Your continued use of the Site after a revision constitutes acceptance of it.

Severability. If any provision is held invalid or unenforceable, it will be interpreted to give effect to its original intent to the extent possible, and the remaining provisions remain in full force and effect.

Waiver. Our failure to enforce any provision is not a waiver of it or of our right to enforce it later.

Limitation on time to file claims. Any claim arising out of or relating to these Terms of Use or the Site must be commenced within one (1) year after the cause of action accrues, or it is permanently barred.
